Decision to assess following mediation

hi - we have a number of occasions where we are requested to 'overturn' a decision not to initiate an EHC assessment at mediation. My understanding is that if this decision is made on the basis of information which was not properly considered as part of the original decision then a 'yes' decision would take that assessment immediately to the week 6 point but that if new and/or previously unseen information is shared than it it is reasonable that the request is taken back through the LA EHCNA decision making process, essentially starting from day 1 and be considered with the new information included in the evidence submitted.


Is this correct? Mediators are telling us that it is unlawful to take a request back to the 'start'.
