Setting refusing to maintain provision
Good afternoon all
Has any LA found themselves in a position whereby the current educational setting (namely a college) is refusing to maintain provision whilst a Tribunal is ongoing? We have a college that is refusing to continue with provision come September for a young person. The college has been reminded of its duties to continue provision, i.e. to maintain the status quo whilst we await the Tribunal hearing (which was listed for December but has been brought forward to October). We are concious of the LA being in breach of its duty to make the special educational provision in the plan until the Tribunal date. The parent has also now lodged an LGO complaint which has been accepted despite the ongoing Tribunal.
